Leaf Your Debt Behind Sweepstakes

Rules
First Heritage Federal Credit Union (“First Heritage”) is the sponsor of the Leaf Your Debt Behind Sweepstakes (the “Sweepstakes”).  These Official Rules (the “Rules”) will govern the Sweepstakes and will be binding on all entrants in the Sweepstakes (collectively, the “Entrant(s)”).  By participating in the Sweepstakes, you agree to be fully and unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements.  In addition, you agree to accept any decision of First Heritage as final and binding as it relates to the Sweepstakes.  No purchase necessary to enter/win.  All entries have an equal chance of winning.  Odds of winning depend on the number of entries.

Eligibility
Subject to the eligibility requirements set forth herein, the Sweepstakes are open to all legal U.S. residents who are at least eighteen (18) years old at the time of entry.  The following individuals are not eligible to participate in the Sweepstakes: (1) employees, officers, board members and other officials of First Heritage; (2) individuals employed or associated with subsidiaries and affiliates of First Heritage; and (3) family members or persons living in the same household, whether or not related, of any individual mentioned in categories 1-2 above. Entrants must be in “good standing” with First Heritage to be eligible, meaning the Entrant (a) has no delinquencies on loans or negative balances on primary accounts; (b) has not had any account with First Heritage closed due to abuse or negligent behavior; (c) has not caused a financial loss to First Heritage; and (d) has not engaged in violent, belligerent, disruptive, or abusive activities with respect to First Heritage or its property or personnel.  Winning is contingent upon fulfilling all requirements set forth in these Rules.  First Heritage shall determine the eligibility of all Entrants in the Sweepstakes.  Eligibility determination is final and no challenge or appeal of such decision by any Entrant will be allowed.  The Sweepstakes are subject to all applicable federal, state, and local laws, and regulations.  Void where prohibited by law.

Sweepstakes Period
The Sweepstakes will run from August 1, 2025, at 12:00 a.m. Eastern Standard Time (“EST”) to October 31, 2025, at 11:59 p.m. EST (the “Sweepstakes Period”).  Entries submitted before or after the Sweepstakes Period will not be considered.

How to Enter
Unless you opt out, you will be automatically entered in the drawing for the Grand Prize (as defined below).  You will earn one entry for each eligible balance transfer made from an existing credit card at another financial institution to your First Heritage Federal Credit Union VISA credit card between August 1, 2025 and October 31, 2025.  New Money Only. First Heritage and its respective officers, directors, agents, volunteers and/or employees are not responsible for lost, late, or misdirected entries, or for any human, electronic or technical error, which may occur in the receipt or processing of the entries submitted for the Sweepstakes.  First Heritage is not responsible for any issues or problems associated with submitting entries, including but not limited to, entries that are late, incomplete, or cannot be completed due to electronic or technical difficulties, even if the issue or problem is the result of the sole or partial negligence or error of First Heritage.

OPT OUT
If you do not wish to receive an automatic entry by making a purchase with a Credit Card, you must email marketing@fhfcu.org, or mail us at Marketing Content/Do not Enter, First Heritage FCU, 202 Denison Pkwy E, Corning, NY 14830 and instruct us not to enter you.

MAIL IN METHOD
To enter without making a purchase, hand print your name, address, day and evening phone numbers, email address, and date of birth on a 3”x5” index card and mail in the completed index card in an envelope with proper postage to Marketing Contest, First Heritage Federal Credit Union, 202 Denison Pkwy E, Corning, NY 14830.  You will receive one entry in the Grand Prize drawing for each envelope containing a completed index card you mail in.  All mail-in entries must be handwritten and must be postmarked by the expiration of the Sweepstakes Period. Entries will not be acknowledged or returned.  Entries that do not comply with these Rules will be disqualified.

Grand Prize
First Heritage will randomly select one (1) grand prize winner from all eligible entries received throughout the Sweepstakes Period (the “Winner”) in accordance with these Rules (the “Drawing”).  The Drawing will be held on or before November 14, 2025.  The Winner will receive a reduction of the balance associated with the Winner’s Credit Card account as of the date of the Drawing by a maximum of $5,000, subject to the conditions below (the “Grand Prize”).  The Winner will not receive any cash or benefit in excess of $5,000 and may receive a lesser amount as described herein.  If the Winner’s Credit Card account balance is $5,000 or more on the date of the Drawing, an amount equal to $5,000 will be applied to the Winner’s Credit Card account.  If the Winner’s Credit Card account balance is less than $5,000 on the date of the Drawing, an amount less than $5,000, equal to the lesser account balance, will be applied to the Winner’s Credit Card account.  Once the Grand Prize has been applied, any remaining balance owed on the Winner’s Credit Card account, including but not limited to, any remaining principal balance, accrued interest, and fees, will remain due and owing to First Heritage and payments must continue to be made in accordance with the Winner’s existing credit card agreement.  In the event that an Entrant has more than one Credit Card account, the Grand Prize will apply to the Credit Card account used in connection with the winning entry.  In the event that (i) the winning entry was submitted using the mail-in method and (ii) the Winner has more than one Credit Card account, the Grand Prize will apply to the Credit Card account with the highest balance.  The Grand Prize is not transferable, assignable, substitutable, or exchangeable, and cannot be redeemed for cash.  The Winner must comply with all of the terms and conditions of these Rules, and receipt of the Grand Prize is contingent upon fulfilling all of the requirements set forth in these Rules.  First Heritage reserves the right to substitute a prize for one of equal or greater value if the Grand Prize becomes unavailable for any reason. First Heritage has the right, in its sole and absolute discretion, to cancel or discontinue the Sweepstakes at any time for any reason.  The name of the winner can be obtained by sending a self-addressed, stamped envelope to: Marketing Contest, First Heritage Federal Credit Union, 202 Denison Pkwy E, Corning, NY 14830.

Winner Selection
The Winner need not be present at the Drawing to win.  The Winner will be contacted via phone, email, or mail within five (5) business days of the date of the Drawing.  First Heritage will not be responsible or liable for late, lost, misdirected or unsuccessful efforts to notify the Winner.  The Winner must respond to First Heritage within five (5) business days after being contacted and (i) supply proof of identity, (ii) provide authorization for the release of his or her social security number for tax reporting purposes, (iii) complete and sign an Acknowledgment and Release in the form provided by First Heritage, accepting the Grand Prize as awarded and certifying acknowledgment and compliance with these Rules, and (iv) provide or have a photo taken.  Failure to (a) respond within five (5) business days of notification or (b) comply with the requirements of these Rules will result in automatic forfeiture of the Grand Prize.  In the event the Grand Prize is forfeited, a new winner will be drawn. 

Additional Terms
All Entrants accept and agree to be bound by these Rules.  First Heritage reserves the right to change any of the terms in these Rules or to discontinue the Sweepstakes at any time without advance notice.  First Heritage reserves the right to disqualify any Entrants that fail to follow these Rules or make any misrepresentations relative to the Sweepstakes and/or redemption of the Grand Prize.

Privacy Policy
All information submitted in connection with the Sweepstakes is subject to the Privacy Policy posted on First Heritage’s website, available at https://www.fhfcu.org/privacy-policy.

Publicity
All Entrants grant to First Heritage, its affiliates and subsidiaries, and each entity’s respective officers, directors, employees, independent contractors, representatives, agents, partners, insurers, successors and assigns (collectively, the “Releasees”) the unrestricted right to use, print, publish, broadcast, reproduce, distribute, prepare derivative works of, and display such Entrant’s name, town, city, or county of residence, photograph or likeness and biography, and any statements made by Entrant relating to the Sweepstakes, for advertising and promotional purposes, in any and all forms of media, whether now known or hereafter devised, without any further compensation or permission.

Limitations of Liability
First Heritage is not responsible for: (1) any incorrect or inaccurate information, whether caused by Entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human intervention error which may occur in the administration of the Sweepstakes or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused directly or indirectly, in whole or in part, from the Entrant’s participation in the Sweepstakes or receipt or use or misuses of any prize.  If for any reason an Entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Entrant’s sole remedy is another entry in the Sweepstakes, if it is possible.  No more than the stated number of prizes will be awarded.  In the event that production, technical, seeding, programming or any other reason cause more than the stated number of prizes as set forth in these Rules to be available and/or claimed, First Heritage reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.

Indemnification and Release
By submitting an entry, each Entrant, on behalf of such Entrant and on behalf of such Entrant’s heirs, executors, administrators, representatives, successors and assigns, irrevocably, unconditionally and expressly releases, discharges, relinquishes and waives all right to, and agrees to indemnify, defend, and hold the Releasees harmless from and against, any claim, liability, loss, demand, action, assertion, fine, penalty, assessment, and damage (including without limitation, punitive, incidental, special, indirect, incidental, exemplary and consequential damages), cost or expense (including attorneys’ fees and costs) arising out of, related to, or in connection with the Entrant’s participation in the Sweepstakes or any Sweepstakes-related activity, and/or the Entrant’s acceptance, use, or misuse of the Grand Prize; any breach of these Rules by the Entrant; any misrepresentation or fraud by the Entrant; any violation of law or regulation by the Entrant; any warranty, representation or guarantee, express or implied, or any other act or omission by the Entrant or any Releasee related in any way to the Sweepstakes and/or the Grand Prize; the conduct of the Sweepstakes; any third party claims in relation to the Sweepstakes or the Grand Prize; and/or any other matter, issue, cause or thing arising out of or related to the Sweepstakes or any prize, or otherwise.  SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.  The provisions of this paragraph shall survive the completion or termination of the Sweepstakes and the awarding of the Grand Prize.

Taxes
First Heritage will report all winnings to the appropriate agencies as required by applicable law.  The Winner shall be solely responsible for the payment of all applicable taxes, fees, costs, and expenses associated with the Grand Prize based on applicable federal and state laws, rules, and regulations.  The amount of the Grand Prize will be reported as taxable income to the Winner.  All federal, state and local taxes imposed by acceptance of the Grand Prize are solely the responsibility of the Winner, and the Winner is responsible for the reporting and payment of any such taxes.

Choice of Law
You agree that all matters arising out of or relating to the Sweepstakes and these Rules are governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any of its conflict of laws provisions thereof.

Forum
You agree that any legal suit, action, or proceeding arising out of or relating to the Sweepstakes and these Rules shall be brought exclusively in the applicable federal or state courts located in the Northern District of New York, and you expressly and irrevocably consent and submit to the personal and subject matter jurisdiction of such courts and waive any right to bring any suit, action or proceeding except in those courts.
